About investment

BY THE GRACE OF GOD ALMIGHTY

President of the Republic of Indonesia,

Weigh:

a. that in order to realize a just and prosperous society based on Pancasila and the 1945 Constitution of the Republic of Indonesia, it is necessary to carry out a sustainable national economic development based on economic democracy to achieve the goals of the state;

b. that in accordance with the mandate stated in the Decree of the People's Consultative Assembly of the Republic of Indonesia Number XVI/MPR/1998 concerning Economic Politics in the context of economic democracy, investment policies should always underlie the people's economy involving development for micro, small, medium, and cooperative businesses;

c. that in order to accelerate national economic development and realize Indonesia's political sovereignty and economic sovereignty, it is necessary to increase investment to process economic potential into real economic power by using capital that originates, both from within the country and from abroad;

d. that in dealing with changes in the global economy and Indonesian participation in various international cooperation it is necessary to create a climate of investment that is conducive, promotive, providing legal certainty, justice, and efficiently while still paying attention to the interests of the national economy;

e. That Law Number 1 of 1967 concerning Foreign Investment as amended by Law Number 11 of 1970 concerning Amendment and Additional Law Number 1 of 1967 concerning Foreign Investment and Law Number 6 of 1968 concerning Domestic Investment as amended by Law Number 12 of 1970 concerning Change and Supplement of Law Number 6 of 1968 concerning Domestic Investment Need to be replaced because it is no longer in accordance with the needs of accelerating economic development and national law, especially in the field of capital planting;

f. that based on the considerations as referred to in letter a, letter b, letter c, letter d, and letter e it is necessary to form a law on investment.

Bearing in mind: Article 4 paragraph (1), Article 5 paragraph (1), Article 18 paragraph (1), paragraph (2), and paragraph (5), Article 20, and Article 33 of the 1945 Constitution of the Republic of Indonesia;
